Risk Acknowledgment

I acknowledge that there are risks associated with using this facility, including but not limited to risks associated with physical activity and the use of equipment. I understand that the facility cannot guarantee my safety and that I am responsible for my own safety while using the facility.

Furthermore, I acknowledge, that:
The workshops and activities offered : Blacksmithing, Welding, Machining, Woodworking, Glass working, Soapmaking, Metal Casting and any and all other activities including visiting the studio during events and open studio hours may pose a risk of injury to participants. While particular safety rules are in place, and if properly followed, safety equipment is used, and personal discipline exercised they may reduce this risk; The risk of serious injury or death does exist.

Waiver & Release of Liability

I for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY WAIVE AND RELEASE ANY AND ALL RIGHTS TO MAKE A CLAIM AGAINST Dark Angel Armory and Forge LLC dba. The Guild, Urban Craft and Folk Art School, its owners, officers, officials, agents and/or employees, the participants, any volunteers, instructors, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors and lessees of premises used to conduct the activities or events ( hereinafter known as the “RELEASEES”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

Idemnification & Hold Harmless

I agree for myself and on behalf of my heirs, assigns, personal representatives and next of kin to indemnify and hold harmless all the foregoing from any claims which I might make or which might be made on my behalf by others or which might be made against me by others, arising from my participation in RELEASEES activities or events.

Severability

Should any provision of this Waiver and Release of Liability, Assumption of Risk and Hold Harmless Agreement be held void or unenforceable, the remaining provisions thereof shall be of full force and effect.

Acknowledgment

By signing this waiver and release, I understand that I am giving up, (waiving and releasing) any right I might have to sue or make a claim which I might have or which might subsequently arise or occur against the releasees, for any injuries and damages I might sustain while participating in an event or activity provided by or held by or at the premises of the releasees, and that;

I am indemnifying and holding harmless the releasees from any claims which I might make or which might be made on my behalf by others or which might be made against me by others, arising from my participation in any of the releasees’' events or activities.

It is my intent to give up these rights and provide this hold harmless agreement, and I do so knowingly and voluntarily without any inducement.

Waiver & Release of Liability

I for myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby waive  and release any and all rights to make a claim against Dark Angel Armory and Forge LLC dba. The Guild, Urban Craft and Folk Art School, its owners, officers, officials, agents and/or employees, the participants, any volunteers, instructors, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors and lessees of premises used to conduct the activities or events at ( hereinafter known as the “RELEASEES”), with respect to any and all injury, disability, death, or loss or damage to person or property, whether arising from the negligence of the  RELEASEES or otherwise, to the fullest extent permitted by law.

Photo/Video and Audio Release

I hereby grant permission to any photos or video taken during the workshop, course or event I’m attending without payment or any other consideration.  I understand that my image may be edited, copied, exhibited, published or distributed and waive the right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of my image or recording.  I also understand that this material may be used in diverse educational settings within an unrestricted geographic area.    Photographic, audio or video recordings may be used for the following purposes:  • educational presentations or courses  • informational presentations  • on-line educational courses  • educational videos  •marketing and promotion    By signing this release, I understand this permission signifies that photographic or video recordings of me may be electronically displayed via the Internet or in the public educational setting.  There is no time limit on the validity of this release nor is there any geographic limitation on where these materials may be distributed.  This release applies to photographic, audio or video recordings collected as part of the sessions listed on this document only.  By signing below I acknowledge that I have completely read and fully understand the above release and agree to be bound thereby. I hereby release any and all claims against any person or organization utilizing this material for educational purposes.

I'm the parent or legal guardian of the above listed minor. I'm signing and accepting this Liability Waiver & Release on behalf of the forementioned minor, on behalf of myself and on behalf of all other parents or legal guardians of the minor. I'm also signing this form and waiver as an authorization for my child (or this minor) to participate in the RELEASEES' events or activities and I also authorize any emergency medical care which may be necessary. I represent and warrant that I have the authority to give this release and authorization.
